Brief Summary of Experience:
I have experience advising employers about issues ranging from hiring and disciplinary practices to privacy issues such as drug testing and telephone monitoring. I offer legal knowledge and focused practical experience to help managers make realworld judgments while minimizing potential exposure. I have experience involving such issues as reasonable accommodation of disabilities; sexual harassment; "glass ceiling" claims; discrimination claims arising out of reductions in force; individual disparate treatment claims; wrongful discharge/public policy claims; employment contract matters; and enforcement of non-competition and confidential information obligations. I am committed to providing aggressive and cost-effective representation. If mediation is appropriate, I work with management representatives to assure they are well prepared. In litigating cases, I emphasize thoughtful preparation of legal and factual defenses, thorough deposition discovery with an eye toward summary judgment, and use of expert witnesses. I can most effectively defend management's fundamental right to manage by providing practical advice at the personnel management stage, well before problems reach litigation. I can assist in the design of employment policies and procedures that effectively balance concerns of protecting management prerogatives against the need to demonstrate fairness and reasonableness when presenting management's side of an employment dispute to a jury, judge, arbitrator, or investigator. If there is a dispute, I can help human resources executives and line managers develop concrete evidence that will assist in the demonstration of appropriateness of a manager's actions. |
